This Technical Regulation establishes the requirements for radio equipment that is supplied on the market and is put into operation in Ukraine, regardless of the form of delivery, including the sale of radio equipment remotely. This Technical Regulation is based on Directive 2014/53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC.


Clause 3 is one of the main points of this resolution of the Cabinet of Ministers of Ukraine.

To establish that placing into the market of radio equipment that was placed into the market before the date of entry into force of this Resolution and meets the requirements of the Technical regulations on radio equipment and telecommunications terminal equipment, approved by Resolution of the Cabinet of Ministers of Ukraine No. 679 dated June 24, 2009 (Official Journal of Ukraine No. 50, 2009, Article 1705), Technical regulations on electromagnetic compatibility of equipment, approved by Resolution of the Cabinet of Ministers of Ukraine No. 1077 dated December 16, 2015 (Official Journal of Ukraine No. 2, 2016, Article 72), Technical regulations for low-voltage electrical equipment, approved by Resolution of the Cabinet of Ministers of Ukraine No. 1067 dated December 16, 2015 (Official Journal of Ukraine No. 102, 2015, Article 3526) cannot be banned or restricted for reasons of non-compliance with the requirements of the Technical Regulations approved by this Resolution.

This document makes it clear that if one has a document confirming the compliance of the product with the technical regulations that were in force before the adoption of this Resolution, or the product has been placed into the market before the adoption of this document, one has every right to freely sell these products in the territory of Ukraine.
